Terms and Conditions of Warranty for Glydsphere Products

IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS AS WELL AS THE RESTRICTIONS AND EXCLUSIONS APPLICABLE TO YOU AND YOUR PURCHASE OF GLYDSPHERE PRODUCTS DUE TO THE GRANTING OF A WARRANTY.

 

1. YOUR RIGHTS AND THIS WARRANTY POLICY


This warranty (this "Warranty Policy") applies to your purchase of certain audio speakers or related items or products (a "product” in each case) from Space Gravity GmbH or its authorised agent ("Space Gravity", "we", "us" or "our") which, among other things, may be used with the Glydsphere mobile applications ("apps"). The terms and conditions of sale applicable to the products can be found in our << Terms of Sale >>. This Warranty Policy shall apply to you only if you are the original end purchaser of the product. This Warranty Policy does not apply to the apps.
 
The following terms and conditions, which describe the prerequisites and the scope of our warranty, shall not affect our warranty obligations arising from the purchase contract concluded with you.

 

2. WHAT THIS WARRANTY POLICY COVERS; WARRANTY PERIOD

We guarantee that the product will be free from material and manufacturing defects for a period of one (1) year and one day from the date of purchase (the "warranty period").

 

If the product does not comply with this Warranty Policy during the warranty period, we will, at our sole discretion, either

(a) repair or replace the defective product or any component thereof; or

(b) if, according to our discretion, neither of the alternatives mentioned under (a) should be feasible, accept the return of the product and refund the amount paid by you for the product.

At our sole discretion, the repair or replacement may be effected using a new or refurbished product or component thereof.

Should the product or a component it contains no longer be available, we may, at our sole discretion, replace the product or component with a similar product or a component with a similar function.

Any product or component thereof that has been repaired or replaced under this Warranty Policy will remain covered by this warranty for the remainder of the warranty period, if applicable.

This Warranty Policy shall not apply to Excluded Products (as defined below).

This Warranty Policy does not cover defects that occur as a result of normal wear and tear.

 

3. TERMS AND CONDITIONS OF WARRANTY; SUBMITTING A CLAIM UNDER THIS WARRANTY POLICY


Before you can make a claim under this Warranty Policy, you must (a) inform us of your intention to make a claim during the warranty period (b) provide us with an adequate description of the alleged defects in the product or its component(s), and (c) follow our return shipment instructions.
You can notify us by email (support@space-gravity.com) by sending the corresponding information and description. Return instructions are provided on the product website.
We shall have no warranty obligations in respect of a returned product or its component(s) if, after examining the returned product, we determine in our reasonable discretion that it is an Excluded Product (as defined below).

 

4. WHAT THIS WARRANTY POLICY DOES NOT COVER


This Warranty Policy does not cover the following products (collectively the "Excluded Products"): products that have been (i) modified, changed or manipulated in an unauthorised manner or which have been incorrectly maintained or repaired; (ii) incorrectly handled, stored, installed, tested or used, including, but not limited to, as a result of failure to follow product documentation or other instructions provided by us; (iii) used incorrectly or misused; (iv) subjected to failures, fluctuations or interruptions in the power supply or the telecommunications network on which the product depends; (v) exposed to "force majeure", including lightning, flood, tornado, earthquake or cyclone; or (vi) used not in accordance with their intended use. Any use of the product that is not in accordance with its intended use may impair the performance of the product and void this Warranty Policy.

 

5. NON-TRANSFERABILITY OF THE WARRANTY POLICY


This Warranty Policy shall not be transferable from the original purchaser of the product to any subsequent owner or purchaser. It may not be transferred, assigned, or passed on to other persons by the original purchaser.

 

6. PLACE OF PURCHASE OR OPERATION

 

These terms and conditions of warranty shall only apply to products purchased in the European Economic Area (EEA), including the United Kingdom (UK) and Switzerland.

 

7. ENTIRE AGREEMENT


This Warranty Policy represents the entire and complete agreement between us and you with regard to the independently granted warranty for the product. This Warranty Policy does not supplement, replace or affect the terms and conditions set out in other documents applicable to our website, apps or services.

 

8. COPIES OF THE WARRANTY POLICY


This Warranty Policy is available on the following page of the website: www.glydsphere.eu. You can print a copy of this Warranty Policy from the website. We may also provide you with a copy of this Warranty Policy upon delivery of the product(s) (this copy may be part of the product instructions or manual delivered together with the product(s)).
